Sending a takedown notice

Write to the agent above. Under 17 U.S.C. §512(c)(3)(A) a notice must include all of the following, or it is not effective and we may not be able to act on it:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you say was infringed — or, if several works at one site, a representative list.
  3. Identification of the material you say is infringing, with enough detail for us to find it (a direct link is best).
  4. Your address, telephone number, and email address.
  5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and — under penalty of perjury — that you are the owner or authorised to act for the owner.

Section 512(f): anyone who knowingly misrepresents that material is infringing can be liable for damages, including costs and legal fees. Please be sure before you send.

If your material was removed by mistake

If we removed something of yours and you believe it was a mistake or a misidentification, you can send a counter-notice under §512(g)(3). It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and where it appeared before it was removed.
  3. A statement under penalty of perjury that you believe in good faith it was removed as a result of a mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if you are outside the United States, any district where we may be found), and that you will accept service of process from the person who sent the notice.

We forward a valid counter-notice to the person who complained. If they do not tell us within 10 to 14 business days that they have filed a court action, we may restore the material.

Repeat infringers

We terminate the accounts of users who repeatedly infringe, in appropriate circumstances. That is a condition of the protection this page exists to preserve, and we apply it.
